Work Terms

1. Business Hours. Services shall be rendered by Pixeva during Normal Business Hours. The term “Normal Business Hours” shall mean those hours between 8:30 a.m. and 5:30 p.m. EST each Monday through Friday through the year, exclusive of Holidays (New Years Day, Good Friday, Memorial Day, Independence Day, Labor Day, Thanksgiving Thursday and Friday, Christmas Eve and Christmas). The term “After-Hours Services” shall include all services rendered, in Pixeva's sole discretion, at times other than during Normal Business Hours. After-Hours Services other than on Holidays that are rendered at the request of Client shall be calculated at the rate of one and one-half (1½) times the actual hours of services rendered. The term “Holiday Services” shall include all services rendered, in Pixeva’s sole discretion, during Holidays. Holiday Services that are rendered at the request of Client shall be calculated at a rate of two (2) times the actual hours of services rendered.

2. Incompatible Software or Systems. Pixeva will reserve the right to stop the provision of Services if evidence of incompatibility with Client's system, network or applications software become evident. In such instances Pixeva will notify Client of the problem and Pixeva and Client will jointly decide on the course of action to take.
