I was the victim of a hit and run on June 10, 2021. The sheriff's arrested the driver two weeks later. The DAs office filed one count of felony hit and run. The defendant was held to answer at a preliminary hearing on July 11, 2021. As a result of the hit and run I have had two surgeries on my left shoulder; One on June 14, 2021, and one on November 30, 2022. There are videos of the hit and run, eye witnesser and evidence that the scrapes on the drivers truck were polished off after the hit and run. Photos were taken 5 hours after the hit and run then 3 days later the side of the truck was polished. After 15 court appearances the DAs office is prepared to offer the defendant a plea. The DDA emailed me the following..
Good Afternoon Mr. Wampler:
The offer being conveyed to Mr. Murphy, is as follows: Mr. Murphy will plead to the charge as a felony, but not sentenced. Probation and sentencing will be put over for one year. During that year, Mr. Murphy will need to take a driver’s safety class and do community service. At the year mark, if Mr. Murphy completes all the terms and conditions, he will be sentenced to a misdemeanor and be on summary probation for one year. If he fails to complete the terms and conditions he will be sentenced to a felony.
Jane M. Creighton
Deputy District Attorney IV
I have asked DDA Creighton not to offer this plea and have met and spoken with the Head DA at Van Nuys asking him not to offer it.
I would like to see an article written on this. I know that the Acorn would published it, Not should about the bigger papers.
I included a link to a short story that channel 7 did on in on October 11, 2021.
