The basic elements of the sales contract

Elements The offer and acceptance of a contract of sale must be in conformity with the essential elements of this contract.  An essential element of a sales contract is the nature of the contract, i.e. sale, price and sale.



 1- The nature of the contract (sale): The seller and buyer must agree on the nature of the contract in order for their desires to offer and accept the sale converge.



 If the will of one of the contracting parties is directed towards selling while the will of the other contracting party is directed towards another contract, then the contract is not concluded, even if the parties call this contract a sale.  If the owner of a residential apartment says to another: Take this apartment and give me one million pounds, and he intends to mortgage it with this amount, and this person accepts the offer, believing that the owner of the apartment is selling it.  It is not mortgaged, because offer and acceptance are not identical, neither for sale nor for mortgage, and therefore there is no sale or mortgage.  There is no mortgage.



 Which is 2- The price: It is not enough for the seller and the buyer to agree on the nature of the sale contract, but it is necessary to agree on the price.  If the seller asks for one million pounds in the residential apartment, and the buyer pays only 900 thousand pounds, then the offer and acceptance are not identical, and the sale does not take place, because the seller and the buyer did not agree on the price.  .



 3- Sale: The seller and the buyer must agree on the thing sold with their agreement on the nature of the contract and the price.  If another person offers another person to sell him his residential apartment in Damascus, and he agrees to buy his residential apartment in Aleppo, the offer and acceptance do not coincide, and the sale contract is not concluded, because the seller and the buyer did this.  Do not accept what has been sold .
