Law is a code of conduct that governs our daily life in some or other way. It is well said that well being of humanity and public at large depends broadly upon the order, progress, work transparency and relevancy of not only social but political institutions also. Law is omnipresent and so is our customs, traditions, faith and beliefs which may differ from place to place and sect to sect and which also influence our law. In every era, whether it is the earlier so called “dharma” or modern day law, has always represented social force. History and Law both are connected as many laws given in our holistic Indian Constitution have been codified and shaped up in accordance with our morals and customs that were followed and are still followed in our society. Earlier, disapproval or violations of these cultural norms were looked as sin and offenders were dealt with strict punishment enforced by the head of the community. These boundations of morals and faiths have taken deep root in our country that reflects in our Constitution and encircles each and every person of our country in its arena. Apart from the maintenance of fundamental order, providing security and equal opportunities to everyone, adjustment of conflicts between individuals and groups which if they themselves do will encroach upon each others interests & rights, the great function of law also include refraining or restraining of those customs which are socially, morally and legally wrong. Law is not merely a body of formal rules and regulations possessing objective validity but is an institution the development of which is an inseparable part of the social process. These developments keeps updating invariably as per the due passages of times, as per our need & requirements and also keeping in mind emergence situation socially, financially & politically. Needless to mention we have the rich historical legacy enabling us to frame laws commonly though placed differently. In a country like India being a nation vast in area comprising various religions, casts, sects etc. consisting and based on numerous regions & languages or otherwise reflecting contradictions it is not very easy to make laws for all however we have aptly evolved harmoniously a mechanism & methodology to compile, chart out & make such laws & rules based upon our socio-cultural perspectives keeping the basic thread intact soothing & applicable to one & all with few exceptions only justifying and meeting out the hopes & aspirations, to deal with any situation effectively. Of course demography & topography have an impulsive effect over the enforcement & execution of such laws effectively however till date due to our concrete historical, social bondage & background we are able to overcome all hiccups & hindrances to be proudly boasting as democratic nation based upon Rule of Law.
