Legal Services – Commercial Condominium Project

Project Overview

Monterey Shore Holdings, LLC is seeking proposals from qualified land use attorneys to provide legal services related to the conversion of an existing commercial property into a commercial condominium project.  


Project Location: 71905 Highway 111, Rancho Mirage, CA 92270

APNs: 684-352-005 and 684-352-011 

General Plan & Zoning: General Commercial (C-G)  


The project involves subdividing the existing commercial property into approximately six (6) condominium units for individual sale. A Tentative Parcel Map (TPM) for Condominium Purposes will be processed separately. The selected attorney will prepare and process all legal documentation required for the establishment and governance of the condominium project, including bylaws and CC&Rs.


Scope of Work1. 

1. Legal Document Preparation

- Draft and finalize Covenants, Conditions & Restrictions. 

- Prepare Association Bylaws. 

- Draft a Condominium Plan consistent with California law and City of Rancho Mirage requirements. - Ensure compliance with the Commercial and Industrial Common Interest Development Act, and any other applicable laws.


2. Entity Formation & Governance

- Advise on and prepare documentation for the creation of a Homeowners’ Association. 

- Prepare Articles of Incorporation, Organizational Minutes, and related documents. 

- Provide legal guidance regarding developer rights and obligations.


3. Coordination with Entitlement & Design Teams

- Coordinate with the Entitlement consultant, surveyor, and design team. 

- Review project documents for consistency with recorded CC&Rs and governing documents.


4. Agency Review & Processing

- Submit CC&Rs, Bylaws, and legal documents for review by the City and other agencies. 

- Address agency comments and revise documents.


5. Public & Client Representation

- Provide ongoing legal support throughout the entitlement and approval process.


Submission Requirements

- Firm qualifications and relevant condominium conversion experience. 

- Resumes of attorneys to be assigned. 

- Proposed scope of services and fee structure.
